Pistol Braces Under Fire

It was bound to happen. The last few years everyone has been flaunting their SBR workaround and the government is striking back. Right here in Ohio, they charged a guy for an unregistered SBR because of a brace and angled foregrip. They even filed to suppress the ATF letters that determined those were legal. That's the problem with determination vs law. Only one is binding.

Not sure why there is such an issue with a SBR?

The law makes no sense. It's an antiquated, ineffective throwback to the roaring twenties. Barrel length is one of the dumber things to regulate, but it is the law we are currently working with.

Maybe it is a case that in a few years make it to SCOTUS and get the outdated and unconstitutional laws/regulations tossed.

Yet, we keep voting for people who support this jackassery about gun laws....
No one in government is going to push for over-turning gun laws.

As I always say - it doesn't matter what the law is, an ATF agent or local local can ruin your day (week, month, etc) even IF you know the law and they don't. Power to enforce vs being correct are ≠.

Changing NFA laws is not on any politicians list of things to do. True pro-gun candidates are almost non-existent and NFA is a small niche group nobody even considers. The fact that the people in charge get to interpret the laws as they choose is a serious problem. The NFA division, and the ATF as a whole, are playing fast and loose with our rights. Even a politician who is mostly pro-gun isn't going out on a limb to protect us. Especially when a new shooting happens. Trump joins right in with the antis every time some jackass shoots up a gun free zone.

They can definitely ruin your day...initially.  However, if the law is on your side and you're willing to slug it out with them you'll likely be fine in the long run.  Tampa P.D. found that out the hard way when they arrested the guy that was open carrying while fishing (which is completely legal in Florida).  They cuffed him and searched his car and ran his weapons through the data base (which is illegal because they had no PC and no legal grounds to begin with).  So in the long run Tampa got hit with violating his Constitutional rights and all their officers had to go through mandatory training.  He may have even won a chunk of change.  So yeah, he plans that day were derailed but the law was on his side and sometimes you do have to fight City Hall.
